Please read these Terms of Use carefully. By downloading, installing, or using the NetChecker mobile application ("App"), you agree to be bound by these Terms. If you do not agree, do not use the App.

1 Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and the developer of NetChecker ("we", "us", or "our") governing your use of the NetChecker mobile application and any related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to update or modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.

2 Description of Service

NetChecker is a network diagnostic tool that performs connectivity tests on your device, including but not limited to:

  • HTTP/HTTPS endpoint reachability and latency testing
  • TCP port connectivity testing
  • UDP protocol testing (DNS, NTP, STUN)
  • Download and upload bandwidth measurement
  • Network type detection (WiFi, mobile data generation)
  • Public and local IP address discovery

The Service is provided "as is" for diagnostic and informational purposes only. Test results may vary based on network conditions, device capabilities, and server availability.

3 User Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. The Service is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

4 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to probe, scan, or test the vulnerability of any system or network without authorization
  • Use the Service to conduct denial-of-service attacks or excessive automated requests
  • Reverse engineer, decompile, or disassemble any portion of the App
  • Remove, obscure, or alter any proprietary notices or labels in the App
  • Interfere with or disrupt the Service or servers connected to the Service

5 Intellectual Property

The App, including its code, design, graphics, logos, and all content, is the exclusive property of the developer and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

NetChecker™ and the NetChecker logo are trademarks of the developer. All other trademarks, service marks, and trade names are the property of their respective owners.

6 Third-Party Services

The Service integrates third-party services including but not limited to:

  • Google AdMob — for displaying advertisements. AdMob may collect device information and serve personalized or non-personalized ads based on your preferences. See Google's Privacy Policy for details.
  • Public diagnostic targets — the Service tests connectivity to publicly available servers (e.g., google.com, cloudflare.com). These are standard network diagnostic targets and no account or authentication is required.

We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is subject to their respective terms and policies.

7 Advertising

The Service is supported by advertising. By using the Service, you agree to the display of advertisements provided by Google AdMob and other advertising partners. Advertisements may be displayed as banners, interstitials, or native ad formats within the App.

You may be offered the option to view a rewarded advertisement to access enhanced diagnostic features. This is entirely optional and does not affect core functionality.

8 Data Collection & Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

Key points:

  • Network diagnostic test results (including IP addresses, latency, and bandwidth measurements) are stored locally on your device only
  • We do not operate backend servers that collect or store your test data
  • No user account is required to use the Service
  • No personally identifiable information is collected by the developer
  • Third-party advertising partners may collect device identifiers for ad serving purposes

9 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Test results will be accurate, reliable, or complete
  • Any errors or defects in the Service will be corrected

Network diagnostic results are estimates and may be affected by factors beyond our control, including but not limited to network congestion, server load, device performance, and carrier-specific routing policies.

10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us (if any) for the Service in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of liability, so the above may not apply to you.

11 Indemnification

You agree to indemnify, defend, and hold harmless the developer, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12 Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Hong Kong.

You agree that any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after the claim or cause of action arose, or be permanently barred.

14 Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

1 Information We Collect

NetChecker is designed with privacy in mind. The App operates primarily on-device and does not transmit your personal data to our servers. Here is a breakdown:

2 How We Use Information

All network diagnostic data (test results, IP addresses, bandwidth measurements, latency metrics) is stored locally on your device for the following purposes:

  • Displaying results — showing your current and historical network performance
  • Session history — allowing you to review past diagnostic sessions
  • Trend analysis — comparing current results against your own historical data

This data never leaves your device through our code. You can clear all stored data at any time by clearing the App's storage in your device Settings.

3 Network Diagnostic Targets

When you run a diagnostic test, the App initiates network connections to publicly available third-party servers to measure connectivity, latency, and bandwidth. These connections are standard network operations comparable to visiting a website. The servers we test against include:

  • HTTP/HTTPS targets: google.com, cloudflare.com, github.com, and similar well-known services
  • TCP targets: Standard service ports on public servers
  • DNS targets: Public DNS resolvers (e.g., 8.8.8.8, 1.1.1.1)
  • Bandwidth measurement: Cloudflare speed test endpoints

These servers may log your IP address as part of their normal operation, just as they would for any web request. No authentication credentials or personal data are sent with these test connections.

4 Local Data Storage

The App uses MMKV (a high-performance key-value storage library) to persist data locally on your device. Data stored includes:

  • Diagnostic session history (timestamps, scores, protocol-level results)
  • IP addresses observed during tests (local and public)
  • App preferences

All data is stored within the App's private storage sandbox and is not accessible to other applications. You can delete all stored data by:

  • Going to Settings → Apps → NetChecker → Storage → Clear Data on your device, or
  • Uninstalling the App

5 Third-Party Services & Advertising

The App integrates the following third-party services:

Google AdMob

We use Google AdMob to serve advertisements within the App. AdMob may collect and process certain device information to serve relevant ads, including:

  • Advertising ID (resettable device identifier)
  • IP address (for geo-targeting and fraud prevention)
  • Device type and OS version
  • App usage data (ad impressions, clicks)

AdMob's data collection and use are governed by Google's Privacy Policy. You can manage your ad preferences in Settings → Google → Ads.

Google Play Services

If enabled on your device, Google Play Services may collect crash diagnostics and usage statistics. This is managed by Google and subject to their privacy policy.

6 Data Sharing & Disclosure

We do not sell, rent, or share your personal information with third parties for their direct marketing purposes. We may disclose information only in the following circumstances:

  • Legal Compliance: If required by law, court order, or governmental regulation
  • Protection of Rights: To protect the rights, property, or safety of our users or the public
  • Business Transfers: In connection with a merger, acquisition, or sale of assets

7 Data Security

We take reasonable measures to protect your information:

  • All diagnostic data is stored locally within Android's application sandbox
  • No network endpoints are operated by the developer that could collect or store user data
  • Network diagnostic tests use encrypted connections (HTTPS/TLS) where available

However, no method of electronic storage or transmission is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

8 Children's Privacy

The App is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us so we can delete it.

If you are between 13 and 16 years of age (or the applicable age of digital consent in your jurisdiction), please review this Privacy Policy with your parent or guardian.

9 Your Rights & Choices

Depending on your jurisdiction, you may have the following rights:

  • Access: Request a copy of data stored about you
  • Deletion: Request deletion of your data (clear App storage or uninstall)
  • Opt-out of personalized ads: Via your device's Ad Settings
  • Data portability: Request transfer of your data to another service

Since all diagnostic data is stored locally on your device and we do not operate backend servers, the most direct way to exercise these rights is through your device settings:

  • Clear App data: Settings → Apps → NetChecker → Storage → Clear Data
  • Reset Advertising ID: Settings → Google → Ads → Reset advertising ID
  • Opt out of ad personalization: Settings → Google → Ads → Opt out of Ads Personalization

10 International Data Transfers

The App's diagnostic tests may connect to servers located in various countries as part of normal network testing operations. These connections are initiated from your device and follow standard internet routing. No personal data is transmitted in these connections beyond what is inherent to any TCP/IP connection (e.g., your IP address).

Third-party services integrated into the App (Google AdMob) may transfer and process data on servers located outside your country of residence. Such transfers are governed by the respective third party's privacy policy and any applicable data transfer frameworks.

11 Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the "Effective Date" at the top of this page. We encourage you to review this Privacy Policy periodically. Your continued use of the App after any changes constitutes your acceptance of the updated policy.
